AGREEMENT TO THESE TERMS

We are Can Ayan ("we," "us," "our"), a sole operator established in the Republic of Ireland (Dublin). You can reach us at info@kalibrefin.com, or by post at Dublin, Republic of Ireland.

We operate the mobile application Tennis Tactics (the "App") — a beginner's course in tennis tactics, taught as short illustrated conversations with a coaching character. These Terms of Use ("Terms") form a binding agreement between you and us covering your use of the App.

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

Please read Sections 6 (Subscriptions), 7 (Tennis is a Physical Activity), 10 (Disclaimer) and 11 (Limitation of Liability) carefully. They contain a safety acknowledgment, an assumption of risk, and limits on our liability. If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, your mandatory statutory consumer rights apply on top of these Terms and cannot be waived. Nothing here limits them.

1. WHAT THE APP IS

Tennis Tactics is an educational product. It teaches beginner tennis tactics — where to stand, where to aim, and what to do in common match situations — through short conversations, court diagrams, and scenario questions.

It is a teaching aid, not a coach, not a physiotherapist, and not a medical device. It cannot watch you play, cannot assess your technique, and does not know your body, your injuries, or your ability. Nothing in it is personal advice.

The App works entirely offline. It has no accounts, requires no sign-up, and does not connect to any server of ours.


2. WHO MAY USE IT

The App's content is suitable for all ages, and beginners include children.

To buy a subscription you must be at least 18 years old, or have a parent or guardian aged 18 or over who accepts these Terms on your behalf and makes the purchase for you. Purchases are controlled by Apple; parents can manage or block them with Apple's Family Sharing and Ask to Buy settings.

If you use the App as a minor, you should do so with a parent or guardian's knowledge, and you should be supervised when you take what you learn onto a court.


3. WHAT YOU GET FOR FREE

You do not need to pay to use Tennis Tactics, and you do not need an account.

  • Chapter 1 is completely free — all six lessons, with their diagrams and questions.
  • Beyond Chapter 1, a free player can open one lesson per day, which resets each calendar day.
  • Any lesson you have finished can be replayed for free, forever, whether or not you subscribe.

We may change what is included in the free tier in future versions. Any change applies to versions released after the change; it cannot reach back and lock a lesson you have already completed.


4. LICENCE

Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, limited licence to install and use the App on Apple-branded devices that you own or control, for your own personal, non-commercial use, in accordance with the App Store's Usage Rules.

We reserve all rights not expressly granted.


5. INTELLECTUAL PROPERTY

We own or license everything in the App: the source code, the design, the coaching character and his artwork, the written course, the court diagrams, the scenario questions and explanations, the sound effects, and the name and logo.

All of it is protected by copyright and trade mark law and is provided to you "as is" for your personal, non-commercial use only. You may not copy, reproduce, republish, redistribute, sell, licence, or otherwise exploit any part of it for any commercial purpose without our prior written permission. Using the App's course to build a competing product, or to train a machine-learning model, is not permitted.

If you believe we have infringed your rights. The App contains no user-generated content — everything in it is written and drawn by us — so there is nothing for a third party to upload and nothing for us to take down. If you nevertheless believe something in the App infringes your copyright or trade mark, email info@kalibrefin.com with enough detail to identify the work and where it appears, and we will investigate and remove or license anything we should not be using.

Your feedback. If you send us a suggestion or idea about the App, you agree that we may use it for any lawful purpose without owing you acknowledgment or compensation, and you confirm the suggestion is yours to give.


6. SUBSCRIPTIONS AND PAYMENT

Plans

Unlocking the full course is optional. Two auto-renewing plans are offered:

  • Full Course — Yearly. Includes a 3-day free trial for eligible new subscribers.
  • Full Course — Monthly. No free trial.

Prices are shown in the App in your local currency at the moment of purchase, and may vary by region. The price and billing period displayed on the purchase screen are the ones that apply.

A subscription unlocks every chapter and every side quest, with no daily limit.

Billing and renewal

All purchases are processed by Apple through your Apple Account, under Apple's billing terms. We never receive or store your payment details.

Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends. Apple charges your account within the 24 hours before renewal. You consent to that recurring charge until you cancel.

Free trial

If you start the yearly plan with a free trial and do not cancel at least 24 hours before the trial ends, it converts automatically into a paid yearly subscription at the price shown when you signed up. Free trials are limited to eligible new subscribers, as determined by Apple, and one per Apple Account.

Cancelling

Cancel at any time in iOS Settings → your name → Subscriptions → Tennis Tactics, or from the You tab in the App. Cancelling stops the next renewal; your access continues until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

Refunds

Refunds are handled by Apple, at Apple's discretion. We cannot issue them. Request one at https://reportaproblem.apple.com

If you are an EU, EEA or UK consumer you may also have a statutory right of withdrawal. Because the App gives you immediate access to digital content, that right may be lost once access begins, to the extent permitted by law. Your statutory rights are unaffected by anything in this section.

Price changes

We may change prices. An existing subscriber keeps the price they signed up at until Apple notifies them of a change in the manner required by law and by Apple's rules; a price increase requires your consent before it takes effect where the law says so.


7. TENNIS IS A PHYSICAL ACTIVITY

Please read this section.

Tennis Tactics teaches decisions, not exercises. It does not prescribe training, conditioning, or drills. But what you learn here is meant to be taken onto a tennis court, and playing tennis carries inherent physical risk — including sprains, strains, falls, collisions, impact from a ball or racket, and the risks that come with sudden effort.

  • The App is not medical advice and is not a substitute for a doctor, physiotherapist, or qualified coach. It cannot diagnose, treat, or prevent any injury or condition.
  • Consult a healthcare professional before starting or returning to tennis, particularly if you are pregnant, have a pre-existing condition or injury, are recovering from surgery, or have any concern about your fitness to exercise.
  • Warm up properly, play within your ability, and stop immediately if you feel pain, dizziness, breathlessness, or chest discomfort — and seek medical attention if needed.
  • Some tactics described in the App involve moving quickly, changing direction, or approaching the net. Attempt them at a pace and intensity appropriate to you.

You play voluntarily and at your own risk. By using the App and applying what it teaches, you accept full responsibility for any resulting injury, loss, or damage. To the fullest extent permitted by law, we disclaim liability arising from your play.


8. THINGS YOU MAY NOT DO

You agree not to:

  1. decompile, reverse engineer, disassemble, or attempt to derive the source code of the App, except to the extent applicable law expressly permits it;
  2. modify the App or create derivative works from it;
  3. remove or obscure any copyright, trade mark, or other proprietary notice;
  4. extract, scrape, or republish the course content, the diagrams, or the dialogue;
  5. use the App or its content to build a competing or substitute product, or as training data for a machine-learning model;
  6. use the App for any unlawful purpose, or in breach of any applicable law or regulation;
  7. attempt to obtain paid content without paying for it.

9. APPLE-SPECIFIC TERMS

These Terms are between you and us, not Apple, and Apple is not responsible for the App or its content.

The licence granted to you is limited to a non-transferable licence to use the App on an Apple-branded device you own or control, as permitted by the App Store's Usage Rules.

We, not Apple, are solely responsible for providing maintenance and support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims arising under consumer protection law. In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you as a third-party beneficiary.


10. DISCLAIMER

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This includes any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.

We make no promise that the App will be uninterrupted, error free, or that the tactics it teaches will improve your results. Tennis outcomes depend on your technique, fitness, practice, opponents, and a great deal of chance. The course reflects widely taught tactical principles for developing players; it is general education, not a guarantee.

Nothing in this section limits any liability that cannot be limited under applicable law, and nothing here affects the statutory rights of consumers in the EU, EEA, or UK.


11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we will not be liable to you for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the App.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim arose, or €50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer in the EU, EEA, or UK, your mandatory statutory rights and remedies are unaffected.


12. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or your violation of any law or the rights of a third party. This does not apply to the extent the claim arises from our own breach or negligence, and it does not apply where you are acting as a consumer and applicable law does not permit it.


13. TERMINATION

You may stop using the App at any time by deleting it. Cancelling a subscription is described in Section 6.

We may suspend or terminate your licence without notice if you materially breach these Terms. On termination, your right to use the App ends, and Sections 5, 7, and 10 to 17 survive.


14. CHANGES TO THE APP AND TO THESE TERMS

We may add, change, or remove features, lessons, and content as the App develops, and we may stop offering the App altogether. Where a change materially reduces what you have paid for, your consumer rights and Apple's refund process apply.

We may update these Terms. The "Last updated" date at the top will change, and material changes will be announced in the App before they take effect. Continuing to use the App after a change means you accept the revised Terms.


15. PRIVACY

Tennis Tactics collects no personal data. Our Privacy Policy explains exactly what that means, what stays on your device, and what Apple handles when you subscribe. It forms part of these Terms.


16. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules, and the courts of Ireland have jurisdiction.

If you are a consumer resident in the EU, EEA, or UK, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.

Before starting formal proceedings, we ask that you email info@kalibrefin.com so we can try to resolve the matter directly. EU consumers may also use the European Commission's online dispute resolution platform.


17. MISCELLANEOUS

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App.

Severability. If any provision is held invalid or unenforceable, it is severed and the remaining provisions stay in full force.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a transfer of the App, provided your rights are not reduced.

Events outside our control. We are not liable for any delay or failure caused by events beyond our reasonable control.
